Compensation Available After a Car Accident in Georgia

After a car accident in Cobb County, injured people may be able to seek compensation for medical expenses, lost income, property damage, pain and suffering, and, in limited cases, punitive damages. The amount depends on the details of the crash and the extent of the injuries.

Medical expenses often form the largest part of a claim. These may include emergency care, hospital stays, follow-up visits, prescriptions, and ongoing treatment. Future medical needs may also be considered when injuries require long-term care.

Lost income applies when injuries prevent a return to work. This can include missed wages during recovery and any impact on future earning ability. Employment records and medical documentation help support this portion of a claim.

Property damage covers the cost to repair or replace a vehicle and any personal items damaged in the crash. Insurance companies usually handle this portion separately from injury claims. Estimates and valuations help determine the amount owed.

Pain and suffering relate to the physical pain and daily disruption caused by injuries. Georgia law allows recovery for these non-economic losses. The value depends on how the injury affects a person’s routine and quality of life.

Punitive damages may apply in limited situations involving reckless or dangerous conduct. A DUI-related crash may meet this standard under Georgia law. Courts review the facts of each case before awarding this type of compensation.

Insurance claims can become difficult when adjusters dispute injuries, question fault, or delay responses. Early settlement offers may not reflect the full cost of recovery. Keeping records of treatment, missed work, and related expenses helps support a stronger claim.
