If the at-fault driver in a crash is uninsured in Georgia, recovering compensation can become more challenging, but there are still potential options available. Georgia follows a fault-based insurance system, meaning the driver responsible for causing the accident is generally liable for resulting damages.
When the at-fault driver does not have insurance, injured individuals may need to rely on their own uninsured motorist (UM) coverage, if it is included in their auto insurance policy. This type of coverage can help pay for medical expenses, lost wages, and other losses related to the crash.
Insurance companies in Georgia are required to offer UM coverage, but drivers can choose to decline it, so availability depends on the policy.
If uninsured motorist coverage is not available, it may still be possible to pursue a personal claim directly against the at-fault driver. However, collecting compensation in these situations can be difficult if the individual lacks sufficient financial resources.
Since these cases can involve complex insurance and legal issues, reviewing your policy and understanding your coverage is essential. Keeping documentation such as medical records, repair estimates, and any official reports can help support your claim.
A consultation with a lawyer may also help clarify your options and ensure that your rights are protected throughout the process. If you’ve been injured in an accident, don’t wait to reach out to a personal injury lawyer. They can guide you through your options, help you understand potential compensation, and ensure your rights are protected
